Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Four unknown persons came on a Scorpio vehicle and caused firearm injury and death of Anil Vishwas, the son of the informant. During investigation, the wife of the informant stated that she had seen the petitioner entering into that vehicle along with others.

Learned counsel for the petitioner submits that if the wife would have seen the petitioner, the matter must have surfaced in the F.I.R. Petitioner has got no criminal antecedent. He is in custody since 02.01.2019. Investigation of the case is

Patna High Court CR. MISC. No.26709 of 2019(3) dt.04-06-2019 2/2 already complete. There is no eyewitness of the occurrence. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Bhaptiyahi Police Station Case No.131 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
