Petitioner apprehends his arrest in connection with Akbarpur P.S. Case No.255 of 2015 for t he offence registered under section 302/34 of the Indian Penal Code. Petitioner is named in the first information report with accusation that he also participated in assaulting the deceased. Learned counsel for the petitioner submits that coaccused Ram Bhajju Singh @ Bhajju Singh having similar allegation has already been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court vide order dated 27.7.2016 passed in Cr. Misc. No.23500 of 2016 but in my view, it is not a fit case for grant of anticipatory bail to the petitioner and,

Patna High Court Cr.Misc. No.44972 of 2016 (2) dt.08-12-2016 2/2 accordingly, I am not in agreement with the opinion of a Coordinate Bench of this Court, the prayer for anticipatory bail of the petitioner in connection with Akbarpur P.S. Case No.255 of 2015 stands rejected.
