2. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 506, 354A, 354B, 504, 453, 380, 307 and 427 of the Indian Penal Code.
3. According to F.I.R., on 03.05.20 at about 11:30 AM, all 19 F.I.R. named accused persons, along with 50-60 unknown persons, armed with lathi, danda and iron rod, came at the house of informant and started abusing and assaulting. The accused persons levelled allegation against the informant that the informant's side had concealed the nephew of Naresh Bhuiyan in their house. It is further alleged that the accused
Patna High Court CR. MISC. No.28234 of 2026(2) dt.11-05-2026 2/3 persons attempted to enter into house of informant and upon protest, they badly dismantled the household articles and took Rs. 20,000/-. The accused persons also tried to outrage the modesty of informant.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has committed no offence. Petitioner is not named in the F.I.R. and has got no concern with the alleged occurrence. Name of petitioner transpired in this case during investigation, merely on the basis of confessional statement of apprehended co-accused persons and save and except confessional statement, there is no material on record to show the complicity of this petitioner in the alleged occurrence. It is further submitted that similarly situated co-accused person has already been granted anticipatory bail by this Hon'ble Court vide order dated 01.09.2025 passed in Cr. Misc. No. 59001 of 2025. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, claim based on parity and clean antecedents of the petitioner, the prayer for
Patna High Court CR. MISC. No.28234 of 2026(2) dt.11-05-2026 3/3 grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 77 of 2020, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) shashank/- U T
