This application for grant of anticipatory bail arises out of Begusarai Muffasil P.S. Case No. 307 of 2015, disclosing offences under Sections 341, 323, 427, 506, 385, 188, 387 and 379/34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that upon completion of investigation, the Police found the allegation against the petitioner to be false and, accordingly, submitted final report. Learned court below has, however, differing with the findings of the Police report has taken cognizance of the offence and has issued summons to the petitioner, which has necessitated institution of the present anticipatory bail application. It has further been submitted that since investigation is complete, no
Patna High Court Cr.Misc. No.41613 of 2016 (2) dt.29-09-2016 2/2 tangible purpose is going to be served if the petitioner is taken into custody.
I find substance in the submission so advanced, this application is, accordingly, allowed.
Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No. 307 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
