JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2019 This is an application for grant of anticipatory bail in connection with Nirmali P.S. Case No. 146 of 2018 disclosing offences under Sections 341, 323, 324, 307 and 34 of IPC. There is specific allegation against the petitioner no.1 of assault by Axe to the informant and against petitioner no.2 of assault by rod to the wife of the informant. There is also allegation against all the accused persons of assault by lathi and danda and spade.

Submission of the learned counsel for the petitioners is that due to the land dispute, they have falsely been implicated in this case. The injury report clearly shows that injuries are simple in nature.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, Birpur, Supaul, in connection with Nirmali P.S.
