JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 353, 504, 188 of the Indian Penal Code.

The prosecution case is that the informant being a police officer went to investigate Nardiganj P.S. Case No. 32 of 2015 and found that the construction materials were being unloaded during enforcement of Section 144 Cr.P.C proceedings. The petitioner was posted as Jamadar and when he was enquired about snatching of mobile by the accused persons leading to registration of Nardiganj P.S. Case No. 32 of 2015, the petitioner talked to the informant in loud voice and asked the family members to come with arms when they came with lathi and danda and misbehaved with the informant. It is submitted by learned counsel for the petitioner that in the background of land dispute the

No.3125 of 2016 (2) dt.22-01-2016 2/2 accusation has been levelled and prior to the present case the nephew of the petitioner filed written statement before Officer In-charge, Nardiganj Police Station against ill behaviour of Ranjeet Kumar Paswan who was a party to the present proceeding under Section 144 Cr.P.C as well as informant of present case.

Considering the accusation in the background of the fact that the informant went to investigate the case which is between two police personnel, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nardiganj P.S. Case No. 33 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
