====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 05-11-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 467, 468, 471, 409 and 420 of the IPC.

The prosecution story, in brief, is that one Lok Prakash lodged a written report addressed to the Officer-incharge, Amba Police Station stating therein inter alia that the District Magistrate, Aurangabad, has directed to lodge an F.I.R. against Bikrama Prasad, Ex-Nazir, Kutumba Block and therefore, in pursuance of the Letter No. 104 dated 15.06.2018, issued by the District Magistrate, Aurangabad as well as Letter No. 92 dated 16.05.2018, issued from the office of the Deputy Development Commissioner, Aurangabad as well as Letter No.

Patna High Court CR. MISC. No.26164 of 2019(5) dt.05-11-2019 2/3 01 dated 22.10.2017, issued by Ex-Block Development Officer, Aurangabad have also requested that the case be lodged against the accused person.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 08.01.2019. The petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. The matter relates to accounting. The petitioner denies the allegation made in the F.I.R. For the same, a certificate proceeding has also been initiated against the petitioner for recovery of the amount in question. The petitioner further undertakes to participate and cooperate in the certificate proceeding. It is further submitted that the petitioner is ready to deposit an amount of Rs. 5,00,000/- (Rupees Five Lacs) only in the learned court below which shall be subject to final disposal of the case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, the petitioner is directed to deposit an amount of Rs. 5,00,000/- (Rupees Five Lacs) only in the learned court below which shall be subject to final disposal of the case. On doing so, let the
