JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-10-2020 Heard learned counsel for petitioners and learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in Bachhwara P.S. Case No. 231 of 2019 registered for the offence under Sections 302, 201, 34 of the Indian Penal Code. As per the prosecution case, the daughter of the informant was married with the co-accused Bimal Rai and after the marriage, all the accused persons used to torture her and coaccused Bimal Rai also solemnized second marriage with one Jyoti Devi. It is further alleged that on 12-12-2019, co-accused Jyoti Devi, petitioners alongwith other co-accused persons have committed the murder of his daughter.

No.24616 of 2020(2) dt.07-10-2020 2/2 It is submitted on behalf of petitioners that petitioners are said to be Devar of the deceased (brothers of husband of deceased) and they are living separately and have got no concern with the affairs of deceased. There is general and omnibus allegation. It is further submitted that as per prosecution case, the only eye-witness is daughter of the deceased Shobha Kumari has not named these petitioners. Considering the aforesaid facts and circumstances, the bail application of petitioners is allowed. In the event of their arrest or surrender within a period of eight weeks from the date receipt/production of copy of this order, let the above-named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bachhwara P.S. Case No. 231 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
