The petitioner apprehends his arrest in Barun P.S. Case No. 09/2016 registered under Sections 341, 323, 353, 504, 506 of the Indian Penal Code.
The informant, who is an Assistant Teacher (Mathematics) in Government Aided +2 High School, Siris, alleged that he was distributing Panjiyan forms and registration numbers to the students but in the meantime the petitioner came and asked the informant to firstly give his registration number and Panjiyan form; on refusal, the petitioner torn the registration numbers of the students and also assaulted the informant. Learned counsel for the petitioner submits that some altercation took place but the allegation of assault is false. On the face of it, it appears that the petitioner, who is

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Barun P.S. Case No. 09 of 2016. Accordingly, the same is rejected. If the petitioner surrenders in the court below, the court below shall consider the prayer for regular bail of the petitioner on its own merit.
