This application for regular bail arises out of Itarhi P.S. Case No. 169 of 2020, disclosing offence punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

The petitioner's prayer for regular bail was earlier rejected by this Court by an order dated 17.12.2020, passed in Cr. Misc. No. 33176 of 2020. By making this application, the petitioner has renewed his prayer for bail.

Allegedly, the police recovered 1266.480 litres of wine from a lorry tank.

Learned counsel for the petitioner has submitted that

Considering the facts and circumstances, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge- 2nd cum Special Judge, Excise, Buxar, in Itarhi P.S. Case No. 169 of 2020.
