JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 2516 of 2009, registered under Sections 323, 379, 406 and 504 of the Indian Penal Code.

The accusation is that complainant received money under the scheme of Indira Aawas Yojna in her account. The petitioner, who is the associate of village Mukhiya took her passbook of the bank on the pretext that the same is required by the Mukhiya, but later on passbook of the complainant was not returned by this petitioner, when she made complain to Mukhiya then he told to settle the dispute in the Panchyat, but Mukhiya did not take any heed on it. Thereafter, she went to the house of the petitioner and demanded her passbook on which she was

The complainant was in suspicion that under conspiracy, this petitioner withdrew money from her account. Learned counsel for the petitioner submits that, in fact, the complainant wants to take possession of the land of the petitioner illegally and on protest this false case has been lodged and the petitioner has falsely been implicated in this case. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Complaint Case No. 2516 of 2009, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
