2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 120(B) of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, total 16.125 liters illicit liquor was recovered from two different vehicles.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. Petitioner is neither driver nor owner of the vehicles in question. He has been made accused in this case only on suspicion.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that petitioner is seeking pre-arrest bail in a

Patna High Court CR. MISC. No.26198 of 2025(2) dt.06-05-2025 2/2 case which was instituted in the year 2019 and there is no explanation as to why he moved this bail application after six years. Petitioner has got criminal antecedent.

6. Considering the gross delay in filing this application and criminal antecedent, prayer for anticipatory bail of the petitioner is refused.
