The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. The FIR is against unknown and relates to an offence of murder. After investigation, the petitioner was, initially, not sent up for trial as submitted by learned counsel for the petitioner. However, the court below has taken cognizance against the petitioner also.
Considering the material aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.45120 of 2016 (3) dt.03-03-2017 2/2 Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosera, Samastipur/Successor Court in connection with Rosera Police Station Case No. 129 of 2002, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
