JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2018 The petitioner is apprehending his arrest in connection with Bhabhua P.S. Case No. 759 of 2017, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 427, 379, 114, 452, 354(B), 295A & 153A of the Indian Penal Code. Petitioner is named in the F.I.R and allegation against him is that he along with 150 to 200 persons entered into the house of informant and assaulted him and also destroyed the idols of God/Goddess It has been submitted on behalf of the petitioner that no in this case large number of persons have been made accused in this case and petitioner at best can be alleged to be order giver. Heard learned A.P.P. also.
Having heard both sides, considering the fact there is
Patna High Court Cr.Misc. No.13363 of 2018 (3) dt.11-04-2018 2/2 specific allegation against the petitioner of abating the mob and further he has criminal antecedents as he is accused in two more cases, I am not inclined to grant the privilege of anticipatory bail to him rather this application is disposed of with direction to the petitioner to surrender before the court below within a period of four weeks and pray for regular bail and if any such application is filed the court below shall consider the same on merit of the case and shall pass an appropriate order, without being prejudiced by the order of this Court.
