Same was, however, cancelled by the respondent Collector by the impugned order. Aggrieved thereby, the writ petition has been filed. A stand was taken that before cancelling the same, no opportunity of hearing was granted.

Respondents have filed counter affidavit stating therein that the land, which was recorded as government land, was settled with the petitioner(s). However, the settlee did not come in possession thereof. In such circumstance, proceeding for cancellation was initiated in which notice was served on the petitioner to appear. The petitioner appeared and prayed for time which was granted. On the next date, the petitioner did not turn up and the same was cancelled by the order by the competent
