The petitioner seeks modification of the order dated 23.01.2015. It appears that in the said order, it had been directed that if the petitioner fails to deposit the amount of Rs. 750/- per month in the Court below for two consecutives dates, his bail bonds shall be liable to be cancelled. However, the petitioner being a rustic villager could not deposit the said amount being unaware of the procedures of law. It is submitted that the petitioner has now deposited the amounts due and which was to be paid by him to the informant.

Considering the fact that Annexure-3 Series indicates that the substantial amount has now been deposited by the petitioner, let the terms of the order dated 23.01.2015 be modified to the

Patna High Court Cr.Misc. No.45371 of 2016 (2) dt.09.01.2017 P2/2 extent that the bail bonds of the petitioner may now be accepted after the date fixed in the order within four weeks from today. However, the petitioner must continue to deposit the amount of Rs. 750/- per month henceforth and if he again makes any such default, it shall be open to the Court below to take appropriate steps in accordance with law.

In view of the modification order passed, let the bail bonds of the petitioner be accepted.
