JUSTICE BIRENDRA KUMAR ORAL ORDER 19-09-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341/323/504/506/307/353/379/34 of the Indian Penal. For dispute relating to distribution of money for dress allowance, there is allegation against the petitioners of commission of assault and theft as well as attempt to outrage the modesty.
Submission is that daughter of the petitioners was a student of the school and her money was misappropriated by the prosecution-side, for that reason altercation had taken place. Considering the aforesaid fact, let the
Patna High Court Cr.Misc. No.44618 of 2017 (2) dt.19-09-2017 P2/ petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur, Patna/successor Court in connection with Bihta Police Station Case No. 72 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
