Petitioners apprehend their arrest in Nawada Nagar (Kadirganj) P.S. Case No.639 of 2018, registered under Sections 406, 420, 341, 354(B) and 34 of the Indian Penal Code. The gist of the allegation is that informant gave Rs.3,10,000/- to Mithlesh Sharma, who is a constable in B.S.F to provide him job but Mithlesh Sharma did not return his money. When the informant went to demand money, Mithlesh Sharma, his wife and son are alleged to have assaulted the informant.
Patna High Court CR. MISC. No.30633 of 2019(2) dt.09-05-2019 2/2 Learned counsel for the petitioners submits that the petitioners are wife and son of Mithlesh Sharma. They have no manner of concern with the occurrence. No occurrence as alleged has ever taken place. This case has been lodged only to implicate Mithlesh Sharma and his family members in a false case.
Considering the facts aforesaid and the nature of allegation made against the petitioners, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Nawada Nagar(Kadirganj) P.S. Case No.639 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
