====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ----------- 25-07-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Complaint Case No.5 of 2016 registered under Sections 420, 467 and 468/34 of the Indian Penal Code.

The accusation is that the petitioners alongwith five others, under conspiracy, got prepared the forged partition deed putting the signature of the complainant and her husband in which Jai Kumar and Satyam Kumar put their signatures as witnesses. Learned counsel for the petitioners submits that the

Patna High Court Cr.Misc. No.10269 of 2017 (5) dt.25-07-2017 2/2 partition deed was prepared by the Gram Katchery, as such, the allegation against the petitioners to get prepared the forged partition deed is false. Moreover, the co-accused Vikram Kumar, Kailash Das alias Kailash Prasad Das, Bindeshwari Prasad Das alias Bindeshwari Das and Sudhir Chandra Das have already been granted anticipatory bail by a Bench of this Court vide order dated 27.02.2017 passed in Criminal Misc. No.7584 of 2017. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Complaint Case No.5 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
