JUSTICE MIHIR KUMAR JHA ORAL ORDER 18-08-2015 After some arguments, learned counsel for the petitioner seeks permission to withdraw this application in order to enable the petitioner to file an appeal. Learned counsel for the respondent no. 7, however, submits that after removal of the petitioner she has already been appointed in the year 2008, and is continuing since then, on the post earlier occupied by the petitioner. While this Court would not like to say anything more, but then it is made clear that since the impugned

Patna High Court CWJC No.3634 of 2008 (9) dt.18-08-2015 order has been passed by the Director, ICDS as contained in Annexure-F to the counter affidavit and the impugned order dated 05.02.2008, is only a consequential order, the appeal of the petitioner if filed, can be entertained by the competent authority, if the Angabadi Sevika guidelines, so permit.

That being so, this application is permitted to be withdrawn with the aforementioned liberty.
