JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-01-2022 Heard Mr. Sandip Kumar Gautam, learned counsel for the petitioner and Mr. Ajay Kumar No. 2, Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Khagaria (Mahila) PS Case No. 14/2020 registered for the offence punishable under Sections 498(A), 34 of the IPC and Section 3⁄4 of the Dowry Prohibition Act.

The informant was married to the petitioner in the year 2017 and after marriage, the petitioner along with other accused persons started demanding Television, Fridge, AC, motorcycle etc., as dowry and due to non fulfillment of the same, petitioner and other tortured the informant physically as well as mentally.

Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner and he has not committed any offence in the manner alleged. He next

Patna High Court CR. MISC. No.38061 of 2021(2) dt.07-01-2022 2/2 submits that petitioner is in custody since 13.02.2021, chargesheet has been submitted and there is no likelihood that petitioner will abscond or tamper with the evidences, if he is released.

Having regard to the submissions made by the parties and taking into consideration the material on record and nature of allegation and the fact that petitioner is in custody since 13.02.2021, charge-sheet has been submitted and there is no likelihood that petitioner will abscond or tamper with the evidences, if he is released, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, CHANDAN KUMAR @ SONU KUMAR be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of Smt. Simmi Kujur, learned Judicial Magistrate 1st Class, Khagaria/ court concerned in connection with Khagaria (Mahila) PS Case No. 14/2020. (Anil Kumar Sinha, J) perwez U T
