The petitioner apprehends his arrest in Shahpur P.S. case No. 04 of 2018 for the offences punishable under Section 307, 379 and other Sections of the Indian Penal Code. The informant named the petitioner along with other accused persons and alleged that on 04.01.2018 he went to irrigate his wheat crop but he found that someone put pieces of bricks in the tube well. The informant was abusing but in the meantime Bijendra Rai, Rahul Kumar, son of Bijendra Rai, Makchan Rai, two sons of Lalji Rai and petitioner came there and abused the informant and assaulted him with Lathi. The petitioner is alleged to have taken out Rs. 5000/- from the pocket of the informant. The learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.17886 of 2018 (2) dt.06-04-2018 2/2 there is land dispute between the parties. The father of the petitioner filed a suit and the same was decreed in his favour. The informant preferred appeal in the High Court. There is no allegation of assault against the petitioner. The injury report (Annexure-2) shows that informant got simple injuries. Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Danapur, Patna in connection with Shahpur P.S. case No. 04 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
