====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 12-02-2018 Heard Sri Praveen Kumar, learned counsel for the petitioner and Sri Nawal Kishore Prasad, learned Addl. Public Prosecutor.
The sole petitioner, who was driver of a truck, has approached this Court with a prayer to extend the privilege of anticipatory bail in Parsa Bazar P.S. Case No.160 of 2017 registered for the offence under Sections 279, 304 of the Indian Penal Code.
Learned counsel for the petitioner submits that while the petitioner was driving a truck, an accident had taken place, in which one person (brother of the informant) died. It has been argued that it was case of death in a road accident, which occurred accidentally.
Besides hearing learned counsel for the parties, I have also perused the material available on record and after going through
Patna High Court Cr.Misc. No.6653 of 2018(2) dt.12-02-2018 2/2 the same, the Court is of the opinion that it is a fit case for extending the privilege of anticipatory bail. Accordingly, let aforesaid petitioner, namely,Sonu Kumar, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Patna in connection with Parsa Bazar P.S. Case No.160 of 2017, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
