The petitioner apprehends her arrest in connection with Kazimohammadpur P.S. Case No. 321 of 2018 for the offence punishable under Sections 304(B) and 34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner is mother-in-law of the deceased and she lives separately and she has got no concern with the alleged occurrence. Moreover, the informant has also filed a compromise petition before the court below, which is

Patna High Court CR. MISC. No.26924 of 2019(2) dt.24-04-2019 2/2 evident from Annexure-2 series. The husband of the deceased along with his brother have been acquitted by the learned Sessions Judge, Muzaffarpur vide judgment dated 05.02.2019 a copy of which is annexed as Annexure-3. Hence, the petitioner may be granted the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, East Muzaffarpur in connection with Kazimohammadpur P.S. Case No. 321 of 2018 subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) brajesh/- U T
