====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 24-02-2016 Heard Sri Parth Gaurav, learned counsel, who was assisted by Sri Ranjan Kumar Dubey, learned counsel for the petitioners and learned AC to GA No. 12.

The present petition has been filed by the legal heirs of the sole petitioner of the writ petition i.e. CWJC No. 8996 of 2000 for restoring the writ petition.

It was submitted that during the pendency of the writ petition the sole petitioner died. However, due to the said reason the learned counsel who was earlier appearing in this case was not properly instructed and the writ petition stood dismissed on 21.5.2015 due to non prosecution.

After hearing learned counsel for the parties, the present

Patna High Court MJC No.550 of 2016 (2) dt.24-02-2016 2/2 restoration petition is allowed.

Let CWJC No. 8996 of 2000 be restored to its original file provided substitution petition is filed within a period of four weeks otherwise the writ petition shall stand dismissed without further reference to a bench.
