====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sri Krishnapuri P.S. Case No. 48 of 2005 for the offence punishable under Sections 420, 406, 409 and 102(B) of the Indian Penal Code.

Learned senior counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Learned senior counsel for the petitioner further submits that the prayer for grant of anticipatory bail of the petitioner had earlier been rejected by a co-ordinate Bench of this Court. No.25338 of 2019(2) dt.19-04-2019 2/2 this petitioner has been moved before this Court in view of the fresh ground that although final form has been submitted on 12.11.2006 but the learned court below has taken cognizance against the petitioner after 11 long years. Moreover, the petitioner has been made accused in this case on the confession of the co-accused and except confession of the co-accused, nothing is on record against the petitioner. Hence, the petitioner may be granted the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Patna in connection with Sri Krishnapuri P.S. Case No. 48 of 2005 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
