JUSTICE RAKESH KUMAR ORAL ORDER 18-05-2017 On call, none appeared on behalf of the petitioner either to press this petition or to make a prayer for adjournment. Learned AC to Govt. Advocate no.8, by way of referring to the facts disclosed in the counter affidavit and supplementary counter affidavit filed on behalf of Respondent no.3, submits that there is no error either in the order of the District Magistrate or in the order of the Commissioner. He submits that for selection of Anganbari Sevika, the last date of submission of application was 14.05.

2007, whereas in the present case after expiry of the date for receipt of application, the concerned Mukhiya had accepted the application of the petitioner on 15.05.2007 and, thereafter, the petitioner was selected. He submits that after noticing this fact, the District Magistrate by a reasoned order cancelled the appointment of the petitioner and the said order was also affirmed by the Commissioner.

Earlier, on 26.04.2017 on the prayer made by

Patna High Court CWJC No.18649 of 2008 (5) dt.18-05-2017 2/2 learned counsel for the petitioner, the case was adjourned for filing supplementary affidavit to bring on record copy of advertisement. However, record shows that in compliance of the earlier order, no supplementary affidavit has been filed nor anyone has appeared on behalf of the petitioner.

Be that as it may, since none appeared on behalf of the petitioner, the writ petition stands dismissed due to nonprosecution. (Rakesh Kumar, J) NKS/- U
