JUSTICE PRABHAT KUMAR JHA ORAL ORDER 07-01-2019 Even today nobody appears on behalf of the appellant. This second appeal is of the year 1992. From perusal of the record and the order-sheet, it appears that this second appeal was dismissed for non-prosecution on 16.05.2000 but subsequently the same was restored vide order dated 18.07.2000 passed in MJC No.1859 of 2000. Thereafter again the appeal was dismissed on 06.09.2000 on account of non-prosecution. Again the appeal was restored to its original file vide order dated 19.10.2006, passed in MJC No.1215 of 2005 but the learned counsel for the appellant did not appear on 04.01.2019 when the case was taken up for hearing under Order 41 Rule 11 of the CPC. The case was adjourned for today, i.e., 07.01.2019 but again nobody appears on behalf of the appellant.
