JUSTICE JYOTI SARAN ORAL ORDER 01-02-2018 Heard Mr. Jitendra Kumar Roy, learned counsel for the petitioner and Mr. Jitendra Kumar, learned AC to AAG-14, for the State.
A counter affidavit is filed and the parties are in agreement that the grievance of the petitioner has been redressed. According to Mr. Roy, learned counsel for the petitioner, although an order was passed granting ACP bearing Memo No. 391 dated 28.11.2015 but it suffered infirmity and was corrected later on after three years vide order bearing Memo No. 32 dated 23.1.2018, placed at Annexures R/1 and R/2 respectively to the counter affidavit. He submits that although the relief has been granted but the consequences are yet to follow.
Patna High Court CWJC No.78 of 2016 (3) dt.01-02-2018 Since the respondents have been prompt in realizing the mistake to cure the defect and to accord benefit to the petitioner, let the consequence also follow and the authorities concerned shall ensure its compliance within three months of the receipt/ production of a copy of this order.
The writ petition stands disposed of with the directions aforementioned.
