====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 11-01-2023 Heard learned counsel for the petitioner and counsel for the State.

The present application has been filed by the petitioner to sanction the family pension /pensionary benefits and arrears of pension which accrued to the petitioner after death of his father who was working as an Assistant Teacher (Maulvi Trained) in Elementary School Narwal Barwal in Bagha Block-2, Betia, West Champaran. According to the petitioner, his joining is in 1971 and he retired in 1998 from Elementary Urdu School Basantpur, Manatar, West Champaran.

Patna High Court CWJC No.11948 of 2021(3) dt.11-01-2023 2/2 It has been submitted by the counsel for petitioner that upon retirement, his father was received only GPF amount of Rs. 1,31,906/- vide letter dated 27.11.2012. Counsel for the State has filed counter-affidavit submits that it is a very old matter and therefore, all the documents relating to the petitioner's father was demanded from the Headmaster.

In the counter-affidavit, it has been accepted by the State that the said GPF was paid to the petitioner's father in his life. Since the matter is very old therefore, the direction is hereby given to the petitioner that he shall file fresh representation before the authority concerned furnishing all the details of his father available before him to the concerned authority so that the authority shall assailed them to the retiral benefits and assure payment to the petitioner. All paraphernalia is directed to complete within 6 months from the date of filing of the fresh representation by the petitioner and payment shall be ensured 4 weeks thereafter. With this direction, this writ application stands disposed off.
