JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Jalalpur P.S. Case No. 78 of 2016 registered under Sections-307, 379 & other minor sections of the Indian Penal Code. No doubt, there is case and counter case between the parties and persons from both sides sustained injuries and three co-accused have already been granted privilege of anticipatory bail by different benches of this court but in my view, it is not a fit case for grant of anticipatory bail and accordingly, this petition stands disposed off giving liberty to petitioners to surrender before the court below within six weeks from the date of

No.45199 of 2016 (2) dt.23-12-2016 2/2 receipt/production of copy of the order and seek regular bail and if, petitioners do so, the concerned court shall pass appropriate order on the regular bail application of the petitioners particularly, keeping in mind that some co-accused are enjoying the privilege of anticipatory bail and no specific overt act appears to have been attributed against these petitioners.
