The petitioner seeks bail in a case registered for the offence punishable under Sections 20, 22, 23 of the N.D.P.S. Act.

The prosecution case, as lodged by the SSB Officials, is that near Indo-Nepal border they intercepted a motorcycle and apprehended the petitioner and other another co-accused. From the bag of the petitioner, 2 kgs of ganja was recovered. Accordingly, a seizure list was prepared.

It has been submitted on behalf of the petitioner that he is innocent, bears no criminal antecedent and has been falsely implicated in the aforesaid case. Petitioner is languishing in

Patna High Court CR. MISC. No.30968 of 2019(3) dt.05-07-2019 2/2 judicial custody since 19.02.2019.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Sitamarhi in connection with Sonbarsa Police Station Case No. 52 of 2019.
