This application, for grant of anticipatory bail, arises out of Rupaspur P.S. Case No. 24 of 2016 (G.R. No. 339 of 2016, disclosing offences under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.
The petitioner is named in the First Information Report. His name has surfaced on the basis of statement of co-accused, namely, Guddu Kumar, who was
Patna High Court Cr.Misc. No.40612 of 2016 (2) dt.22-09-2016 2/2 apprehended by the police.
Learned counsel for the petitioner has submitted that over and above the statement of said Guddu Kumar, made before the police, there is no material against the petitioner.
However, considering the seriousness of the offence alleged, I am not inclined to grant the petitioner, above named, the privilege of anticipatory bail. This application is, accordingly, rejected.
The petitioner, above named, is directed to surrender before the court below within a period of four weeks from today and seeks regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
