This application for anticipatory bail arises out of Puraini P.S.Case N0. 46 of 2017, disclosing offences under Sections 147,148,149,341,323,324,504,506,379,307 of the Indian Penal Code.
Allegation against the petitioners is of having entered into the School premises and assaulted the informant and damaged the properties of the School.
Learned counsel appearing on behalf of the petitioners has submitted that the Headmaster of the School is not the informant, rather, his elder brother alleges that he was present in the School in the absence of his younger brother. He further submits that allegation in the First Information Report stands
Patna High Court Cr.Misc. No.42988 of 2017(2) dt.20-09-2017 2/2 falsified by the injury report, which suggests minor injuries. I am satisfied with the submissions, which have been advanced on behalf of the petitioners for grant of anticipatory bail. Considering the above submission, this application is allowed.
Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Udakishunganj (Madhepura) in Puraini P.S. Case No. 46 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
