JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-05-2018 The petitioner seeks bail in anticipation of his arrest in connection with Gopalpur P.S. Case No. 16 of 2017 dated 07.02.2017 instituted for the offences under Sections 366(A), 386 of the Indian Penal Code.
The mother of the victim girl has alleged that her daughter went out of her house on 06.02.2017 but did not return. Later, some unknown person called on her mobile telephone and informed that her daughter is in his captivity and that she will be reached to her home provided Rs. 50,000/- is paid. Hence, the subject F.I.R.
During the course of investigation, the daughter of the informant returned, whose statement under Section 164 Cr.P.C has been recorded. In her 164 Cr.P.C statement, she
Patna High Court Cr.Misc. No.25661 of 2018 (2) dt.04-05-2018 2/2 has stated that she had married the petitioner of her own volition and she has been staying with him for the last one year in a rented house. In the aforesaid 164 Cr.P.C statement, she has disclosed her age to be 22 years. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-IX-cumA.C.J.M, Patna in connection with Gopalpur P.S. Case No. 16 of 2017, G.R. No. 980 of 2017.
