The petitioners apprehend their arrest in Mansahi P.S. case No. 06 of 2016 under Section 307, 380 and other Sections of the Indian Penal Code.
The informant alleged that, while she was engaged in domestic work, the petitioners came to her house and began to abuse. Md. Razzak, petitioner No.1, assaulted the mother of informant with bamboo stick on her head. Petitioners No.2 and 3 also assaulted her with fists and slaps. Petitioner No.1 is alleged to have taken away Rs. 45,000/- from the house of informant. It is submitted that the occurrence took place on
Patna High Court Cr.Misc. No.39915 of 2016 (2) dt.20-09-2016 2/2 29.02.2016 but the fard bayan was lodged on 02.03.2016. The mother of informant got three injuries, which are pain and swelling. The injuries are simple in nature. There is counter version of occurrence being Mansahi P.S. case No. 07 of 2016. Considering the fact that there is case and counter case and on account of some dispute quarrelling took place in which both sides sustained injuries but the injuries are simple in nature, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Katihar in Mansahi P.S. Case No. 06 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
