2. The petitioner seeks bail in connection with Gaya Muffasil P.S. Case No. 1275 of 2023 instituted for the offences under Section 394 of the Indian Penal Code.

3. The allegation against the petitioner along with others is of assaulting the informant. It is further alleged that the accused persons has also snatched informant's scooty key, mobile and cash of Rs. 5,000/-.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no concern with the alleged occurrence. No incriminating/looted article has been recovered

Patna High Court CR. MISC. No.30194 of 2024(2) dt.22-04-2024 2/2 from the conscious possession of the petitioner rather the recovery has been made from co-accused Toni Manjhi and petitioner has no concern with him. On the basis of suspicion and high-handedness of police, petitioner has been falsely implicated in the present case. Charge-sheet has been submitted in this case. The petitioner is in custody since 27.12.2023 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case as well as the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Gaya Muffasil P.S. Case No. 1275 of 2023.
