JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-11-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner seeks bail in Kurhani P.S. Case No. 731 of 2019 registered for the offence under Section 392 of the Indian Penal Code.

As per prosecution case, on 07-11-2019 at 8:00 PM, three unknown miscreants looted key of motorcycle, bag containing SBI ATM card, driving licence and other documents with cash of Rs. 21,000/- on the point of pistol. It is submitted on behalf of petitioner that petitioner is not named in the FIR. Name of the petitioner has come on the confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioner. Charesheet has already been submitted and petitioner is in

Patna High Court CR. MISC. No.27618 of 2020(3) dt.09-11-2020 2/2 custody since 18-01-2020.

However, learned A.P.P. for the State has vehemently opposed the bail application and submitted that there is specific allegation against this petitioner and petitioner has got criminal antecedent, as stated in paragraph - 3 of the petition. Considering the aforesaid facts and circumstances as also criminal antecedent of petitioner, the bail application of petitioner stands rejected.
