Mr. MD. ARIF ====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 07-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Narayanpur P.S. Case No. 21 of 2017 registered for the offence punishable under sections 363, 366 of the Indian Penal Code. Learned counsels appearing for the petitioner submits that allegation of rape is against co-accused and not against this petitioner. Petitioner is a Government Servant and there is no chance of his absconding.

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named in the first information report with specific allegation. In the statement under section 164 Cr.P.C., victim has stated about the complicity of this petitioner.

Patna High Court Cr.Misc. No.36106 of 2017(3) dt.07-09-2017 2/2 Considering the nature of allegations levelled and the submissions advanced on behalf of the parties, this court does not find it to be a fit case for grant of anticipatory bail. It is, accordingly, rejected.
