Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 420/406/120B of the Indian Penal Code.

Prosecution's case in short is that the petitioners did not transfer the ownership of the truck in question in favour of the informant even after payment of its full amount. Learned counsel appearing for the petitioners submits that the petitioners are innocent. He submits that the informant did not pay the total money according to oral agreement and tried to usurp that money by instituting the instant case. However, the truck is also in the possession of the informant. He

Patna High Court CR. MISC. No.24648 of 2020(2) dt.08-10-2020 2/2 submits that no case under sections 420/406 Indian Penal Code is made out against the petitioners. Petitioners have got no criminal antecedent.

Considering the facts of the case, in the event of arrest/surrender, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in GR No. 2125/2017, Barahara Police Station Case No. 170/2017, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
