====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 08-12-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Hilsa P. S. Case No.334 of 2020, instituted for the offences under Section 304(B)/ 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 23.03.2021, he is a person with clean antecedent, charge-sheet has been submitted in the case and is the father-in-law of the deceased.

The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that his daughter was married with Pradum Bind on 07.05.2020 and at the time of marriage, the informant given cash of Rs.3,00,000/- and other

Patna High Court CR. MISC. No.37702 of 2021(2) dt.08-12-2021 2/3 articles worth of Rs. One Lakh. After marriage, the husband and his family members started demanding an Apache motorcycle and a golden chain. On account of non-fulfilment of the demand, the deceased was tortured.

It is next alleged that on 19.07.2020, villager informed that the accused persons named in the F.I.R. has killed his daughter and trying to dispose off the dead body. On the above information, the informant came to the house of the deceased where he found the dead body was lying in the house and it is alleged that on seeing the informant, the accused persons fled away.

The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the allegations are general and omnibus in nature. The petitioner being father-in-law would not have used the Apache motorcycle and as far as the demand of chain is concerned, it is ornamental in nature. The mother-in-law has been granted anticipatory bail by a Bench of this Court by order dated 23.06.2021 in Cr. Misc. No.12837 of 2021. The learned counsel for the petitioner further submits that the allegation against this petitioner is similar to mother-inlaw, who has been granted anticipatory bail.

Considering the fact that the petitioner is in custody since 23.03.2021, he is a person with clean antecedent, chargesheet has been submitted in the case and the petitioner is fatherin-law of the deceased and mother-in-law has been granted anticipatory bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Hilsa P. S. Case No.334 of 2020.

The application stands allowed.
