The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 149, 363, 332, 336 and 337 of the Indian Penal Code.
Allegation is that the accused persons named in the F.I.R. and 20-25 unknown persons attacked the police party and caused obstruction in discharge of official duty. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. As per the allegation, a truck had met with an accident, which led into
Patna High Court Cr.Misc. No.52344 of 2016 (2) dt.08-12-2016 2/2 protest by the local villagers. The petitioner has got no concern with the said truck in question. He is not the owner of the said truck.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Nawada in connection with Warisaliganj P.S. case No.51 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
