2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 96 and 3(5) of BNS and Sections 8 and 12 of the POCSO Act.

3. The case of the prosecution is that the petitioner has kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the learned trial court has recorded the statement of the victim under Section 183 of BNSS. Learned trial court has recorded that the victim has stated that she left her house without informing to anyone to Bhagalpur

Patna High Court CR. MISC. No.28233 of 2026(2) dt.04-05-2026 2/2 Station and from there, she went to Ludhiana by train as her parents wanted her to marry against her wish. Learned counsel has further submitted that the statement of the victim goes to show that she herself has left her house. No one has kidnapped her. There is no role of this petitioner in the alleged occurrence. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 14.10.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nathnagar P.S. Case No. 291 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Exclusive Spl. Judge (POCSO) cum- District and Additional Sessions Judge VI, Bhagalpur.
