Petitioner apprehends arrest in connection with Saharsa Sadar P.S. Case No. 77 of 2019 registered for the offence punishable under sections 406, 420/34 of the Indian Penal Code and sections 103, 104 Trade Mark Act. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. As a matter of fact, there is no complain against this petitioner of cheating. From the allegations levelled in the first information report, neither any case under the Penal Code nor under the Trade Mark Act is made out. At best, a
Patna High Court CR. MISC. No.27356 of 2019(2) dt.29-04-2019 2/2 case under the Trade and Merchandise Act can only be made out against this petitioner.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 77 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
