21-09-2015 Heard learned counsel for the petitioner and learned A.C. to Standing Counsel - 22.
The petitioner has invoked the writ jurisdiction under Article 226 of the Constitution of India, with a prayer to direct the respondents to grant him 1st Time Bound Promotion on completion of ten years of his service and benefit under the A.C.P. scheme on completion of 24 years of service.
It is the case of the petitioner that he was appointed as Assistant on 25-04-1980 in the East Champaran Collectorate. Despite the fact that he has completed 28 years of unblemished service, he has not been granted either 1st time bound promotion or benefit under the ACP scheme. On perusal of the writ petition, it is evident that no representation has been filed by the petitioner.
Patna High Court CWJC No.11549 of 2008 (4) dt.21-09-2015 2/2 In view of facts and circumstances, without passing any positive order, the Court contemplates to dispose of the writ petition granting liberty to the petitioner to file a detailed representation before the respondent no. 2 i.e. Collector, East Champaran, Motihari. If such petition is filed within a period of eight weeks from today, the Court expects that respondent no. 2 may examine the same in its right perspective and decide it within a period of three months from the date of filing of such representation.
With above observation and direction, the writ petition stands disposed of.
