The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 30(d) and 41 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, on a raid being conducted, it is stated that seeing the police personnel, 8-10 accused persons managed to escape. About 1200 litres of liquor under preparation was recovered. The petitioner was named amongst the accused who had managed to escape by the local people.

It is submitted by learned counsel for the petitioner that neither the petitioner has been arrested at the spot nor any incriminating article has been recovered from his possession. He

Patna High Court CR. MISC. No.37584 of 2021(2) dt.27-08-2021 2/2 has been falsely implicated in the case because of his antecedents. He is in custody since 8.3.2021 and investigation in the case has concluded.

It is further submitted by learned counsel for the petitioner that the mother of the petitioner died on 20.8.2021 and hence, the urgency in hearing of this case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the petitioner is directed to be enlarged on bail in connection with Warisaliganj P.S. Case no.74 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Nawada.
