This application, for grant of anticipatory bail, arises out of Khaira Police Station Case No. 73 of 2017, disclosing offences under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that there is general and omnibus allegation against this petitioner and no specific overt act is attributed to him. In fact there is land dispute between the parties and on account of that this petitioner has been made accused in this case. Neither specific case is made out against the petitioner nor Section 354 is leveled against the petitioner, which is evident form the F.I.R. itself. Moreover,
Patna High Court Cr.Misc. No.41886 of 2017 (4) dt.13-11-2017 co-accused, Raghunath Ravidas, Uday Ravidas, Vikash Ravidas, Malti Devi and Sanju Devi, having more or less similar allegation, has also been granted anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No. 34682 of 2017. Hence, the petitioner deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Khaira Police Station Case No. 73 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
