2. The petitioner has invoked the writ jurisdiction of this Court challenging the notice dated 02.12.2025 issued by the Collector-cum-District Magistrate, East Champaran, Motihari in Case No. 105 of 2025-26, as contained in Annexure P/5.

3. Learned counsel for the petitioner submits that the

Patna High Court CWJC No.6609 of 2026(2) dt.14-05-2026 2/3 land in-question was settled in the name of the petitioner's father in Settlement Case No. 1-56/73-74 and Jamabandi No. 2304 has been created since long and after his death, the petitioner is in possession of the said settled land and he has been regularly paying the rent to the State Government. However, the Circle Officer forwarded a proposal for cancellation of the jamabandi which was created in favour of father of the petitioner before the Collector-cum-District Magistrate, East Champaran. In view of the said proposal the learned Collector issued notice to the late father of the petitioner vide Case No. 105/2025-26. Pursuant to notice dated 02.12.2025 the petitioner has already appeared and filed his reply to show cause. Learned counsel for the petitioner, therefore, seeks permission to withdraw the present writ petition with liberty to file fresh objection before the District Magistrate-cumCollector, East Champaran, Motihari (respondent no. 2).

Accordingly, the writ petition stands disposed of as withdrawn with liberty to the petitioner to file all factual and legal objections along with supporting documents before the District Magistrate-cum-Collector, East Champaran, Motihari (respondent no.2), who shall consider and dispose of the matter by passing a reasoned and speaking order preferably within six
