The Opposite party No.2 is on bail in connection with Beur P. S. Case No. 09 of 2016, registered for the offences punishable under Sections 406, 409 and 420/34 of the Indian Penal Code by virtue of an order, dated 12.04.2016 passed by the learned Sessions Judge, Patna. This application has been filed by the petitioner, who is informant of the said case seeking cancellation of bail granted to Opposite party no.2.

Learned counsel appearing on behalf of the petitioner has submitted that while granting the privilege of anticipatory bail, the Court of learned Sessions Judge has not taken into account certain additional amount, which was

payable by Opposite party No.2.

This cannot a ground for cancellation of bail granted to an accused. There is nothing on record alleging misuse of privilege of bail.

In that background, this application for cancellation of bail cannot be entertained and is, accordingly, dismissed. (Chakradhari Sharan Singh, J) ArunKumar/- U
