1. Heard learned counsel appearing on behalf of the parties.
2. It is submitted by learned counsel for the petitioner that informant did not turn up in last seven years, despite giving several notice by learned trial court. It is also pointed out that two witnesses were examined before the learned trial court, did not support the case of prosecution.
3. It be so, but same appears not convincing for offence under Section 302 of the Indian Penal Code
Patna High Court CR. MISC. No.39197 of 2016(7) dt.18-04-2024 2/2 as a ground for quashing of petition.
4. While arguing further for a short, learned counsel seeks permission to withdraw the present application with a prayer that learned trial court be directed to conclude the trial expeditiously, as soon as possible, as petitioner is facing the trauma of criminal trial since 2005.
5. Considering the aforesaid, present quashing application stands disposed of as withdrawn with a direction to learned trial court to conclude the trial expeditiously, as soon as possible, in accordance with law.
